By using Psibyl or by creating a Psibyl account (whether through direct registration or through a third-party authentication provider such as Google) you explicitly agree to be bound by these Terms of Service and acknowledge our Privacy Policy.
Use of Psibyl or any authentication method to access Psibyl constitutes your agreement to all terms stated here.
The Psibyl web application (the “Service”) is operated by Psibyl (“Psibyl”, “we”, “us”, “our”). By accessing or using the Service you agree to be bound by these Terms of Service (the “Terms”). If you do not agree with any part of these Terms, you may not access or use the Service.
Our Privacy Policy describes how we handle personal data. It is provided for your information and is not incorporated into these Terms as a contractual term; it may be updated separately as described in that policy.
Psibyl is a divination and self-reflection platform. Cards or symbols are drawn using the results of algorithmic statistical analysis of entropy received from quantum hardware sources. An AI oracle engine then generates a written interpretation of the drawn spread in the context of the intention you provide.
The Service is provided for personal reflection, entertainment, and spiritual exploration. We do not guarantee any specific outcome, accuracy, insight, or result from your use of the Service.
The Service also includes an optional sensory entrainment feature known as the Mind Machine, which presents flashing visual patterns together with binaural audio tones. It is off by default, it carries health risks for some people, and its use is governed by section 03, which you must read before enabling it.
The Mind Machine is an optional feature that plays flickering full-screen visuals and rhythmic binaural audio, meant for use with headphones. It is off unless you switch it on, and before it first runs it asks you to read and accept a short warning.
Like some video games, the Mind Machine uses flashing light and rhythmic sound. A small number of people can have a seizure when exposed to this, including people who have never had one. Do not use the Mind Machine if you have photosensitive epilepsy, a seizure disorder, or migraine with aura, and if you have any doubt about your health, ask a doctor first. Stop and rest if you feel dizzy, nauseous or disoriented, or notice twitching or changes in your vision. Never use it while driving or doing anything that needs your full attention.
Using the Mind Machine is your choice, and you use it at your own risk. By switching it on, you confirm that you have read the warning above and that none of it applies to you, or that a doctor has cleared you to use it.
The Mind Machine is not a medical device and is not intended to diagnose, treat, cure, or prevent any condition. It has not been evaluated by the U.S. Food and Drug Administration or any other regulator, and Psibyl makes no claim that it has any neurological, psychological, or therapeutic effect. Names such as “theta” and “gamma” describe its settings, not a brain state or a benefit.
To the fullest extent the law allows, you release Psibyl and its officers, members, employees, and agents from claims arising from your use of the Mind Machine, including any seizure, injury, or medical episode alleged to have been caused or worsened by it. This is in addition to sections 12 and 13.
Don’t run the Mind Machine where it can be seen or heard by someone who hasn’t read this warning, or by a child.
Psibyl presents statistical metrics — described in the interface using terms such as “Voice”, “signal”, “consciousness influence”, “quantum purity”, and “confidence” — that describe measured properties of a quantum entropy stream. You acknowledge and agree that:
Oracle interpretations are generated by large language models, which may be operated by third parties or by Psibyl, and which we may select and change at any time at our discretion. You acknowledge that this content is machine-generated, is not reviewed by a human before it reaches you, and may be inaccurate, incomplete, inconsistent, or unsuitable for your circumstances. It is not advice, not a professional opinion, and not the statement of any person.
To generate an interpretation, the intention text you type and the results of your draw are transmitted to the oracle provider serving that reading, which may be a third party. See the Privacy Policy for how that data is handled. Do not enter information into an intention field that you would not want transmitted to a third-party AI provider, including but not limited to sensitive personal, medical, financial, or identifying details about yourself or anyone else.
You agree not to:
You retain ownership of the intention text you submit. You grant Psibyl a non-exclusive license to store, process, and transmit that content for the purpose of operating and improving the Service — including but not limited to transmitting it to any oracle provider we use. How we handle personal data, including aggregate and de-identified data derived from use of the Service, is described in the Privacy Policy.
If you build your own spreads, the Service may let you suggest one to be featured for other readers. Suggesting is optional. When you suggest a spread, we receive a copy of it as it is at that moment — its name, description, positions, labels and meanings, and its oracle notes — and the Psibyl team may read all of it. By suggesting a spread you agree that Psibyl may freely publish and adapt this spread: you grant Psibyl a worldwide, royalty-free, perpetual, irrevocable license to use, copy, modify, publish and make available that spread, in whole or in part, as part of the Service, without payment to you.
We are under no obligation to feature any spread, to tell you what we decide, or to keep a featured spread available. If you ask to be credited, we may show your handle beside a featured spread. You may withdraw a suggestion at any time before it is featured. A spread that has already been featured stays available under this license even if you later withdraw the suggestion, delete your own spread, or close your account; closing your account removes any suggestions not yet featured.
The Service may let you share a reading — by generating a link to it, by exporting it, or by copying its text or imagery elsewhere. Sharing is your decision and your responsibility. When you share a reading you disclose its contents, including the intention you wrote and the oracle's interpretation, to everyone who can reach it. What a recipient then does with it is outside our control and outside the Privacy Policy, which governs what we do with your data and not what anyone you send it to does with it.
You are solely responsible for what you share, with whom, and for every consequence of it — including but not limited to any dispute, offense, distress, loss, or harm the shared content causes to you or to any other person, and any use, republication, alteration, or misinterpretation of it by anyone who receives it. Do not share a reading containing information about another person without their agreement.
Sharing cannot be fully undone. Where the Service offers a way to disable a share link, doing so stops further access through that link, but it cannot retrieve or remove anything already viewed, copied, screenshotted, forwarded, cached, indexed, or archived by a recipient or by a third party. Deleting a shared reading under this section has the same limit. Treat a share as permanent, and consider it before you make it.
You can delete readings, export your data, and delete your account as described in the Privacy Policy. Deleting your account is permanent and irreversible.
The Service — including but not limited to its software, interface, visual design, card and symbol artwork, corpus text, and the Psibyl name and marks — is owned by Psibyl or its licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership to you.
You may use, quote, and share the readings generated for your own account for personal, non-commercial purposes. All other rights are reserved.
The Service depends on third-party providers for authentication, data storage, quantum entropy, and AI oracle interpretation. Those providers operate under their own terms and privacy policies. We are not responsible for their acts, omissions, availability, or content, and their involvement does not make them a party to these Terms.
The Service is offered on an as-available basis. We may modify, suspend, or discontinue any part of the Service at any time, and we do not guarantee uninterrupted availability — quantum entropy sources and third-party oracle providers can and do become temporarily unavailable.
We may suspend or terminate your account if you breach these Terms, if we are required to by law, or if we discontinue the Service. You may stop using the Service and delete your account at any time.
The service is provided “as is” and “as available”, without warranty of any kind, express or implied. To the fullest extent permitted by law, Psibyl disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the service will be uninterrupted, secure, or error-free; that any reading, oracle interpretation, statistic, or metric is accurate, meaningful, complete, or useful; or that the service will produce any particular result or insight. No advice or information obtained or derived from the service creates any warranty not expressly stated here.
To the fullest extent permitted by law, Psibyl and its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or relating to your use of or inability to use the service — whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.
Without limiting the foregoing, Psibyl shall not be liable for any decision you make, any action you take, or any action you refrain from taking, in reliance on a reading, an oracle interpretation, or any statistic presented by the service.
Psibyl's total aggregate liability for all claims relating to the service shall not exceed the greater of (a) the total amount you paid us for the service in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty US dollars (US$50).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply to the greatest extent permitted by applicable law, and nothing in these Terms limits liability for fraud, or for death or personal injury caused by negligence, where such limitation is prohibited.
You agree to indemnify, defend, and hold harmless Psibyl and its officers, members, employees, agents, and licensors from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses — including but not limited to reasonable legal fees — arising out of or relating to:
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, at your expense, in which case you agree to cooperate with our defense of that claim.
Please read this section carefully. It requires most disputes to be resolved by binding individual arbitration, and it waives your right to a jury trial and to participate in a class action.
Before starting arbitration, you agree to first contact us at “legal”, here at this particular domain (psibyl.com), with a written description of the dispute and the relief you seek, and to attempt in good faith to resolve it informally. Neither party may commence arbitration until 30 days after that notice is sent.
If the dispute is not resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms or to the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Davidson County, Tennessee or, at your election, conducted remotely or by written submission. Judgment on the award may be entered in any court of competent jurisdiction.
All claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. You and Psibyl each waive any right to a jury trial.
Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive or equitable relief in court to protect its intellectual property rights or to prevent unauthorized access to the Service.
You may opt out of this arbitration agreement by emailing “legal”, here at this particular domain (psibyl.com), with the subject line “ARBITRATION OPT-OUT” within 30 days of first accepting these Terms. Opting out affects only the arbitration and class waiver provisions of section 15; the rest of these Terms continue to apply, and opting out will not affect your account or your use of the Service in any way.
If the class action waiver in section 15.3 is found unenforceable as to a particular claim, that claim shall be severed and heard in court, while all remaining claims proceed in arbitration. This section survives termination of your account and of these Terms.
These Terms are governed by the laws of the State of Tennessee, United States, and applicable United States federal law, without regard to conflict-of-law principles. The Federal Arbitration Act governs the interpretation and enforcement of section 15. Subject to section 15, the state and federal courts located in Davidson County, Tennessee shall have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to the personal jurisdiction of those courts.
Any claim or cause of action arising out of or relating to these Terms or the Service must be filed, or arbitration commenced, within one (1) year after the claim arose. A claim not brought within that period is permanently barred. This applies to the fullest extent permitted by law; where the law of your jurisdiction does not permit a contractual limitation period, or requires a longer one, the shortest period that law allows applies instead.
The Service is offered on a free tier and on paid plans. What each plan includes, its price, and its billing terms are shown to you before you buy, form part of your agreement with us for that purchase, and you will not be charged without your agreement. Payments are handled by third-party payment and billing providers.
A paid plan renews automatically at the end of each billing period and is charged to the payment method you provided, at the price then in effect plus any applicable tax, until you cancel. You can cancel at any time in your account. Cancellation takes effect at the end of the current billing period, and you keep the plan until then.
Moving to a higher-priced plan takes effect once it is paid for, and you are charged for the difference over the rest of the current billing period. Other changes of plan take effect at the start of the next billing period. If a payment fails, we may try it again, and if it remains unpaid we may move your account to the free tier.
Credits and other allowances included with the free tier or a plan have no cash value, cannot be transferred or exchanged, and expire at the end of the period they are granted for. We may change our prices, the allowances each plan includes, and the credits a feature uses. A change to the price of your plan applies from your next billing period after we tell you about it.
Introductory or early-member pricing is offered at our discretion, on the conditions stated when it is offered.
Payments are non-refundable except as these Terms state or as the law requires. If you are a consumer in the European Union, the European Economic Area, the United Kingdom, or Switzerland, you may withdraw from a purchase within 14 days of making it by contacting us (section 20). Because a plan starts as soon as it is paid for, when you buy one you ask us to begin providing it at once; if you then withdraw, we refund your payment less an amount in proportion to the time the plan was provided.
We may modify these Terms at any time. The revised Terms take effect when posted, and the “Last updated” date at the top of this document reflects the most recent revision. For material changes we will take reasonable steps to notify you — by email to the address on your account, or through the Service — and will give the notice applicable law requires. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms. If you do not accept them, you must stop using the Service and may delete your account.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
In these Terms, the words “include”, “includes”, and “including” mean “including but not limited to”, and do not limit the generality of any words preceding them. Section headings are for convenience only and do not affect interpretation.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. You may not assign or transfer these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms constitute the entire agreement between you and Psibyl regarding the Service and supersede any prior agreements.
